Request the records supporting the seller’s interest, the survey plan and an existing C of O where applicable. Read the documents together and verify them against the appropriate records.
What does a deed explain?
A deed of assignment or conveyance records a transaction or transfer. Check the parties, parcel description, date and execution. Ask your lawyer to examine the earlier interest and any registration or consent requirements.
- A document called a deed does not, by its title alone, establish that the seller could transfer the interest.
What does a survey plan show?
The survey plan describes the parcel: its location, size and boundaries. Have a registered surveyor confirm that it identifies the land offered to you. A survey plan is not standalone proof of ownership.
- Compare the plan with the physical parcel.
- Investigate inconsistent identifiers or altered details.
What does a C of O establish?
Section 9 of the Land Use Act provides for a certificate as evidence of a right of occupancy. Check the actual grant, holder, land details and conditions. Do not assume every certificate has the same term or that renewal is automatic.
- Verify the record rather than relying on the document’s appearance.
- Investigate competing interests with your lawyer.
What supporting records matter?
Depending on the transaction, identity records, previous transfers, authority documents and payment records may help explain the history. Ask your lawyer for the list relevant to the specific seller and parcel.
- Request legible copies and compare originals.
- A receipt records payment; it does not replace due diligence.
